Different Types of Child Custody
Interviewer: In terms of child custody, I’ve heard there are several different kinds of custody, or elements of it. I guess there’s physical custody, and then there’s legal custody. Can you talk about the different elements and what they mean?
Adam: Physical custody would mean they stay with the parent, whereas legal custody involves making decisions about the child’s place of school, their healthcare and how it’s administered. Basically, you have more legal control over them.
Interviewer: I see. Someone can have joint legal custody, but then one parent could have sole physical custody, is that right?
Adam: That is right. One could be declared the residential parent while both maintain legal custody. There’s a variety of different ways that custody of children can be determined.
